These Terms of Service ("Terms") govern your access to and use of the Salonday beauty and wellness platform ("Service") available at www.salonday.app and associated applications. By accessing or using our Service, you agree to be bound by these Terms.

1. Account Registration and Access

To use our Service, you must:

  • Be at least 16 years old or the age of majority in your jurisdiction
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be responsible for all activities under your account
  • Salon professionals must provide valid business credentials

We reserve the right to refuse service, suspend accounts, or change eligibility criteria at our discretion.

2. Service Description

Salonday provides an all-in-one beauty and wellness platform including:

  • Salon/spa discovery and booking system
  • Beauty product marketplace
  • Salon management tools (scheduling, inventory, CRM)
  • Loyalty programs and promotional tools
  • AR try-on features for beauty products
  • Analytics and reporting for business owners

We may modify or discontinue features at any time without notice.

3. Acceptable Use

You agree not to:

  • Violate any laws or third-party rights
  • Use the Service for fraudulent or abusive purposes
  • Reverse engineer or attempt to extract source code
  • Overload our infrastructure with excessive requests
  • Introduce malware or harmful code
  • Circumvent any access restrictions
  • Misrepresent services, qualifications, or products
  • Book appointments without intention to honor them
  • Post false reviews or manipulate ratings

Violations may result in immediate account termination.

4. Intellectual Property

All rights, title, and interest in the Service (including software, trademarks, and content) remain our exclusive property. We grant you a limited, non-exclusive, non-transferable license to access and use the Service as permitted by these Terms.

You retain ownership of any data you submit to the Service, granting us a worldwide license to process it for service delivery. Salon professionals grant Salonday rights to display their business information, photos, and service offerings on the platform.

5. Payments and Billing

For paid subscriptions and transactions:

  • Service fees are payable in advance and non-refundable except as required by law
  • Product purchases may be refundable per individual salon policies
  • We may change pricing with 30 days notice
  • Taxes are your responsibility unless otherwise stated
  • Automatic renewals continue until canceled
  • Salons are responsible for honoring booked appointments

Free trials may convert to paid subscriptions automatically unless canceled before trial ends.

6. Booking and Cancellation Policies

Salon appointments:

  • Individual salons set their own cancellation policies
  • Late cancellations may incur fees as stated at time of booking
  • No-shows may result in account restrictions
  • Salons must honor confirmed appointments

7. Data Protection

Our Privacy Policy explains how we collect and use data. You agree to comply with all applicable data protection laws regarding any information you process through our Service, including sensitive health or beauty preference data.

8. Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We may perform maintenance with reasonable notice when possible. Emergency salon communications will be prioritized during outages.

9. Third-Party Services

The Service may integrate with third-party platforms including payment processors, accounting software, and product suppliers. These services have their own terms, and we are not responsible for their functionality or content.

10. Beauty Service Disclaimer

Salonday is a booking platform and marketplace. We do not:

  • Employ or supervise beauty professionals
  • Guarantee service outcomes or satisfaction
  • Verify all professional credentials (though we may perform basic checks)
  • Endorse specific techniques or products

Customers book services at their own discretion.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits or revenue
  • Data loss or corruption
  • Security breaches not caused by our negligence
  • Personal injury or unsatisfactory service outcomes
  • Product quality issues from third-party sellers

Our total liability for any claim related to the Service is limited to fees paid by you in the 12 months preceding the claim.

12. Indemnification

You agree to defend and indemnify us against any claims arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your infringement of third-party rights
  • Beauty services provided or received
  • Products sold through the marketplace

13. Governing Law and Disputes

These Terms shall be governed by the laws of [Your Jurisdiction]. Any disputes shall be resolved through good faith negotiations, with arbitration as a fallback option. Beauty service disputes should first be directed to the providing salon.

14. Changes to Terms

We may modify these Terms with notice via email or in-service notification. Continued use after changes constitutes acceptance. Salon owners will receive prominent notice of changes affecting their business operations.

15. General Provisions

  • These Terms constitute the entire agreement between parties
  • Failure to enforce any provision doesn't constitute waiver
  • If any provision is invalid, the remainder remains enforceable
  • You may not transfer your rights without our consent
  • Salon owners may not transfer their business profile without verification
